Ratificat per Espanya, aquest tractat <\/a>prohibeix l\u2019exportaci\u00f3 d\u2019armes, municions o components si aquestes podrien utilitzar-se per a cometre genocidi, crims de lesa humanitat, infraccions greus dels Convenis de Ginebra de 1949 o altres crims de guerra, els quals, sense dubte, Israel est\u00e0 cometent a Palestina. Experts de l\u2019ONU han recordat en juny de 2024<\/a> que la transfer\u00e8ncia d\u2019armes a Israel pot convertir a un estat en c\u00f2mplice de crims de guerra, contra la humanitat o, fins i tot, de genocidi. <\/p>\n

La legislaci\u00f3 espanyola<\/a> \u00e9s encara m\u00e9s espec\u00edfica ordenant la denegaci\u00f3 i suspensi\u00f3 de llic\u00e8ncies d\u2019exportaci\u00f3 d\u2019armes que puguen \u201cpertorbar la pau, l\u2019estabilitat o la seguretat en un \u00e0mbit mundial o regional, puguen exacerbar tensions o conflictes latents, puguen ser utilitzades de manera contr\u00e0ria al respecte degut i la dignitat inherent a l\u2019\u00e9sser hum\u00e0, amb fins de repressi\u00f3 interna o en situaci\u00f3 de violaci\u00f3 de drets humans, tinguen com a dest\u00ed pa\u00efsos amb evid\u00e8ncia de desviaments de materials transferits\u2026\u201d. En l\u2019ocupaci\u00f3 israeliana de Palestina es donen des de fa d\u00e8cades totes aquestes situacions. <\/p>\n

Aquesta convenci\u00f3 <\/a>imposa als estats l\u2019obligaci\u00f3 de prevenir-lo i d\u2019establir sancions, el que sembla incompatible amb l\u2019acord preferent de comer\u00e7 entre la UE i l\u2019estat ultra-militaritzat d\u2019Israel, amb tota la cooperaci\u00f3 espanyola en mat\u00e8ria de defensa i amb la compra d\u2019armament israeli\u00e0 i l\u2019adjudicaci\u00f3 de contractes de seguretat, que financen i fan possible el genocidi que la Cort Internacional de Just\u00edcia est\u00e0 investigant, pel qual ha dictat mesures cautelars, i que tants informes qualificats coincideixen en recon\u00e9ixer.<\/p>\n

Finalment, l‘Opini\u00f3 Consultiva de juliol de 2024 de la Cort Internacional de Just\u00edcia <\/a>i la resoluci\u00f3 de l’Assemblea de l’ONU al setembre de 2023<\/a> remarquen l’obligaci\u00f3 que ja van dictar pr\u00e8vies resolucions de l’ONU, que els estats prenguen mesures que acaben amb la pres\u00e8ncia d’Israel en els territoris ocupats de Palestina i no presten ajuda o assist\u00e8ncia en el manteniment d’eixa situaci\u00f3.<\/p>\n

Recordem que el Tribunal Internacional de Just\u00edcia investiga a Israel per genocidi i que el Consell de Drets Humans de l’ONU va sol\u00b7licitar a l’abril de 2024 un embargament d’armes a Israel. Encara que no \u00e9s una part molt important del total d’armament que utilitza l’ex\u00e8rcit Israeli\u00e0, en territori espanyol es fabrica material armament\u00edstic que s’exporta a Israel, ignorant les greus vulneracions de Drets Humans que acumula Israel i les diverses resolucions de l’ONU<\/a> que obliguen a no col\u00b7laborar amb l’ocupaci\u00f3. Entre 2005 i 2022 es van exportar a Israel 28,67 milions d’euros en material militar, i 40,71 milions en material de doble \u00fas. El ministre d’exteriors Jos\u00e9 Manuel Albares va afirmar al desembre de 2023 i al gener de 2024 que des del 7 d’octubre no s’exportava armament a Israel i que Espanya havia \u201crealitzat\u201d un embargament d’armes a Israel, la qual cosa ha sigut repetida pel govern en diverses ocasions. <\/p>\n

Es dona la circumst\u00e0ncia que Noruega t\u00e9 prohibit exportar armes a Israel des de fa vint anys, de manera que Nammo utilitza la permissivitat legal espanyola<\/a> i d’altres pa\u00efsos per a continuar amb el seu negoci.<\/p>\n

Al desembre de 2023 tamb\u00e9 es van exportar a Israel des d’Espanya 125.240 euros en peces de bombes d’aviaci\u00f3 declarades com destinades a re-exportaci\u00f3 a Filipines, pa\u00eds al qual en altres ocasions s’han denegat exportacions per violacions dels Drets Humans<\/a>.<\/p>\n

Espanya va exportar armament a Israel per valor de quasi 50 milions d’euros en 18 mesos (entre gener de 2023 i juny de 2024), definit pel govern com \u201cno letal\u201d.<\/p>\n

Encara que l’executiu afirma que no s’han aprovat noves llic\u00e8ncies d’exportaci\u00f3 des del 7 d’octubre, hauria d’haver revocat les existents, i encara al gener de 2025 el portal DataComex<\/a> mostra 22.730 euros en exportacions d’armes a Israel que, fins i tot sent una xifra xicoteta, prova que no existeix un veritable embargament.<\/p>\n

El 29 d’octubre de 2024, hores despr\u00e9s que es publicara<\/a> la compra, per 6 milions d’euros, de 15 milions de bales a l’empresa israeliana Guardian Homeland Security pel Ministeri d’Interior, aquest va anunciar que iniciava la rescissi\u00f3<\/a> del contracte per a mantindre el seu \u201ccomprom\u00eds de no vendre o comprar armament a l’Estat israeli\u00e0 des que va esclatar el conflicte armat en el territori de Gaza\u201d. Este anunci de rescissi\u00f3 i el citat comprom\u00eds s\u00f3n una gran not\u00edcia, per\u00f2 a m\u00e9s de semblar for\u00e7ats per la revelaci\u00f3 pr\u00e8via, s\u00f3n massa les dades que els contradiuen, considerant a m\u00e9s tot el que no s’arriba a saber per l’opacitat de la informaci\u00f3. Necessitem una declaraci\u00f3 oficial d’embargament que fa\u00e7a impossible cap d’aquestes operacions i que detinga de manera autom\u00e0tica les que encara estiguen en marxa. <\/p>\n

Si \u00e9s necessari anirem denunciant vaixell a vaixell, per\u00f2 necessitem un protocol d’inspecci\u00f3 sistem\u00e0tica a tots els vaixells que paren en ports espanyols i es dirigisquen a Israel, donada l’alta probabilitat, que s’est\u00e0 demostrant, que transporten armament o material de doble \u00fas que ser\u00e0 usat per a cometre genocidi.<\/p>\n

Tamb\u00e9 hi ha evid\u00e8ncies del tr\u00e0nsit per ports espanyols de combustible militar jp-8 (espec\u00edfic per als avions F-16) mitjan\u00e7ant una ruta EUA-Israel que es repeteix mensualment.<\/p>\n

S’identifiquen 12 bancs espanyols, com Santander i BBVA, que han finan\u00e7at a empreses que venen armes a Israel, contribuint amb m\u00e9s de 2.442 i 1.500 milions de d\u00f2lars, respectivament.
